Colleyville Real Estate News: Do I Want to Live With David Bagwell?

A reader writes:

This is regarding David Bagwell. We are in love with his neighborhood, and are considering lot in Broughtonbut his behavior is causing us a lot of concern. Do you know how his bankruptcy has affected his strong hold on his communities?

A little background here: Developer David Bagwell, who once worked with Mayor Leppert at the Trammell Crow Company,  has super strict rules for just about every move you make if you buy a home in one of his five Colleyville developments: who builds the house, who repairs it, what you can plant, where you can plant it, even how many inches away the front door coach lanterns have to be. And when you submit your new home or remodel plans to the Architecture Control Committee, you have to pay a fee. About this time last year here’s what we were discussing on DallasDirt: “David Bagwell is working as hard at staving off foreclosure on some of his Colleyville lots as he once did being the architectural control Nazi of the neighborhood. As one reader put it, not only did he peer over fences to check for compliance, homeowners were charged repeatedly just for submitting and re-submitting requests:

“Candy, you missed one thing about submitting for approval. Not only do you have to submit for approval, if it is declined, you have to pay a fee to resubmit. Basically the entire fee structure is set up to fail to keep submission payments coming in. You have to pay a fee to submit for approval to stain your garage the SAME color it currently is.
The CCR’s are located on Bagwell’s website. If you have 10 hours to waste, go read them.”

I don’t have ten hours to waste. Last I heard, Bagwell’s lots got foreclosed on, Toll Brothers has picked up some of his mortgage notes, which ought  to make homeowners in three of the subdivisions perk up: If Toll bought the 26 lots in Broughton, 49 lots in Old Grove and 36 lots in Whittier Heights, they could ask for control of the development, shake things up at the HOA. Life might be groovy again.

Any of my Southlake/Colleyville readers know if the foreclosure has made these communities a more pleasant place to live? And here we thought fore-closure was a bad thing!

    Well, it sounds like the winners are the residents of this community, finally. They will get a bit of a reprieve from Mr. Bagwell's mountainous and equally ridiculous restrictions and may finally go the way of the dinosaur. Since the name of Tom Leppert was mentioned, I'm going to snatch this opportunity to say that he is first and foremost a businessman and his interests are geared in that direction. I wish him well in any endeavor he has, which for now appears to be the Senate.
    As for the entire Crow family, I have something to say in regard to that entire family, and I'm proud to say I've spent time with many of them in one-on-one encounters. They are all brilliant business folks and brilliant doesn't seem strong enough verbiage to describe any of them. Every Crow I've spent time with is unpretentious and understated folks that are willing to sacrifice enormously to make their clients happy. This Blog isn't large enough for me to sufficiently describe each of them, so let me just say that I do not adore any family as much as the Crow's and I'm so proud Dallas has them and gets to keep them here; after all they were major players in building Dallas and making it the remarkable city that it is.

    Have a great day in foreclosure court Mr. Bagwell and my prayer is that a few of your occupants show up to add to your deserved humility! I’d love to be there to give you a long snicker.

    From what I can tell, there's still not much going on in these neighborhoods. Haven't discussed it with any of the homeowners, but nobody is turning any dirt yet…. Hope that changes soon.

    Mr. Bagwell has been quite succesful in stalling the foreclosure. Although his time is limited…the direct outcome will not be known until the judge assigns someone to oversee the maintenance association. At this time, the neighborhoods look ridiculous! You certiainly wouldn't know that the homeowners have been paying $2400 in annual HOA dues based on the knee high weeds in Whittier Hts. And the disaster zone at the entrance with the tree farm and tin roof rv trailer are just a sight to behold!

    Hopefully, the homeowners will prevail but until then…this is still a story without a happy ending!
